Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and the publisher of the Dana app ("Dana", "we", "us", "our"). By downloading, installing, accessing or using the Dana mobile application or related services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA, or the higher minimum age in your jurisdiction) to use Dana. If you are a minor under the age of majority in your jurisdiction, you may only use Dana with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2. Important medical disclaimer

Dana is a personal-tracking and educational application. It is not a medical device, not a contraceptive, and not a substitute for professional medical advice, diagnosis or treatment. Predictions for period, ovulation and fertile windows are statistical estimates based on the data you enter and may be inaccurate. Do not rely on Dana to prevent or achieve pregnancy, diagnose a condition, or make medical decisions. Always seek the advice of a qualified healthcare professional for any medical question. In an emergency, contact your local emergency services.

3. Your account

  • You are responsible for the accuracy of the information you provide and for all activity under your account.
  • Keep your credentials confidential. Notify us immediately at support@dana-app.com of any unauthorized use.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. License to use Dana

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Dana app for your own personal, non-commercial use on a device you own or control.

5. Acceptable use

You agree not to:

  • Use the Service in violation of any law, regulation, or third-party right.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code, except where permitted by law.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
  • Use bots, scrapers, or other automated means to access the Service.
  • Upload content that is unlawful, infringing, harassing, hateful, sexually explicit involving minors, or otherwise harmful.
  • Impersonate any person or misrepresent your affiliation.
  • Resell, sublicense, or commercially exploit the Service.

6. User content

You retain ownership of the information and content you submit to Dana ("User Content"). You grant us a worldwide, royalty-free, non-exclusive license to host, store, copy, process and display your User Content solely to operate, secure, and improve the Service for you. You are responsible for your User Content and must ensure you have the right to submit it.

7. Privacy

Your privacy matters. Our Privacy Policy describes how we collect, use, store, and protect your personal information, including sensitive health data. By using the Service you agree to the processing described there.

8. Subscriptions and payments

Dana is currently free to use. If we introduce paid features or subscriptions:

  • Prices, billing intervals, and trial terms will be presented before purchase.
  • Purchases made through the Apple App Store or Google Play are processed and billed by Apple or Google under their respective terms.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store or Google Play account settings.
  • Refunds, where available, are handled by the platform of purchase.

9. Third-party services and stores

Dana is distributed through the Apple App Store and Google Play, and uses third-party providers (e.g., cloud hosting, push notifications). Your use of those platforms is subject to their terms. Apple and Google are not parties to these Terms and have no obligation to provide maintenance or support for Dana. To the maximum extent permitted by law, you acknowledge that Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

10. Intellectual property

Dana, including the app, design, branding, logos, text, graphics, and underlying technology, is owned by us or our licensors and protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you. Feedback you provide may be used by us without obligation.

11. Updates, changes and availability

We may update, modify, suspend, or discontinue the Service (or any feature) at any time, with or without notice, to improve quality, security, or compliance. We are not liable to you or any third party for any such change.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or applicable law, or to protect the Service or other users. Sections that by their nature should survive termination (e.g., disclaimers, limitations of liability, indemnity, governing law) will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of predictions, or uninterrupted operation. We do not warrant that the Service will meet your requirements or be error-free.

14. Limitation of liability

To the maximum extent permitted by law, in no event shall Dana, its affiliates, officers, employees or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law.

15. Indemnity

You agree to defend, indemnify and hold harmless Dana and its affiliates from any claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

16. Governing law and disputes

These Terms are governed by the laws of your country of residence to the extent required by applicable mandatory consumer-protection law; otherwise by the laws of the publisher's principal place of business, without regard to conflict-of-laws principles. Disputes will be resolved before the competent courts of that jurisdiction. Nothing in these Terms limits any non-waivable consumer rights you may have under local law.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app and reflected in the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
